This website is operated by R4W ACTIVE (“we”, “us”, “our”), operated by 3L ONLINE PTY LTD. We provide this website and all related information, content, features, tools, products and services (together, the “Services”) to you, subject to these Terms of Service (“Terms”) and any policies referenced in them.

By accessing, browsing, or purchasing from our Services, you agree to be bound by these Terms, as well as our Privacy Policy, Returns Policy, and Shipping Policy. If you do not agree, you must not access or use our Services.

Our store is hosted on Shopify Inc. Shopify provides the e-commerce platform that enables us to sell our products and Services to you.

We may update these Terms from time to time by posting changes on this page. Your continued use of the Services following any updates constitutes acceptance of the revised Terms.

1. ELIGIBILITY AND ACCESS

By using the Services, you confirm that you are at least the age of majority in your place of residence, or you have permission from a parent or legal guardian.

You must not use the Services for any unlawful or unauthorised purpose or in breach of any applicable laws or regulations.

We reserve the right to refuse service, suspend access, or cancel orders at our discretion where permitted by law.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. Accounts must not be transferred, sold, or assigned to any other person.

3. PRODUCTS, DESCRIPTIONS AND AVAILABILITY

We make reasonable efforts to display product information accurately. However, colours and product appearance may vary depending on your device and screen settings.

We reserve the right to limit quantities, restrict sales by region or jurisdiction, modify product descriptions or pricing, or discontinue any product at any time, where permitted by law.

4. PRICES AND PAYMENT

All prices are subject to change without notice and are shown in the currency displayed at checkout.

By placing an order, you authorise us to charge your selected payment method for the total order amount, including shipping and applicable taxes.

We reserve the right to cancel or refuse orders where fraud, misuse, resale activity, or unauthorised transactions are suspected.

5. ORDERS AND CANCELLATIONS

Placing an order constitutes an offer to purchase. Orders are not accepted until confirmed and/or dispatched by us.

Change-of-mind cancellations or order amendments are not guaranteed once an order has been processed.

All refunds, returns, and exchanges are handled strictly in accordance with our Returns Policy.

6. PRE-ORDERS (NO CANCELLATIONS)

Certain products may be offered as Pre-Orders. Pre-Order items are not yet in stock and will be dispatched at a later date, as indicated on the product page.

All Pre-Orders are final and cannot be cancelled, changed, or refunded once placed, including changes to size, colour, shipping address, or delivery method.

Pre-Order dispatch dates are estimates only and may change due to production or freight timelines. Updates will be provided where appropriate.

Once dispatched, Pre-Order items are managed under our Returns Policy, unless otherwise stated.

7. SHIPPING AND DELIVERY

All delivery timeframes provided are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs clearance, weather conditions, or events outside our control.

Risk of loss passes to you once your order is handed to the carrier, to the extent permitted by law.

8. PROMOTIONS, DISCOUNTS AND STORE CREDIT

Promotions, discount codes, and store credits are subject to additional terms disclosed at the time of issue. Promotions may be modified or withdrawn at any time.

Discounts cannot be applied retrospectively unless expressly stated.

9. THIRD-PARTY LINKS AND SERVICES

Our Services may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party sites. Accessing third-party services is at your own risk.

10. INTELLECTUAL PROPERTY

Nothing in these Terms limits your rights under the Australian Consumer Law.

13. LIMITATION OF LIABILITY

To the fullest extent permitted by law, R4W ACTIVE, its directors, officers, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, or consequential loss, including loss of profits, revenue, data, or goodwill.

Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

14. INDEMNITY

You agree to indemnify and hold harmless R4W ACTIVE and its related parties from any claims, losses, damages, liabilities, and expenses arising from your breach of these Terms, misuse of the Services, or violation of any law or third-party rights.

15. TERMINATION

We may suspend or terminate your access to the Services at any time where permitted by law. Obligations and liabilities incurred prior to termination survive termination.

These Terms, together with policies referenced herein, constitute the entire agreement between you and R4W ACTIVE regarding your use of the Services.

18. GOVERNING LAW

These Terms are governed by the laws of the Commonwealth of Australia and New South Wales. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
